GENERAL CONDITIONS
Contained herein are the general sales, delivery, and payment terms and conditions for Bollini Luigi Company with head office in Bologna (Italy), via Malvolta 2/3, VAT ( IVA) 03606401200 , C.F. BLLLGU66D18A944N, and registered with the Italy Chamber of Commerce.
1. General
1.1 The following sales, delivery and payment terms apply to all deliveries and services.
1.2 By placing an order the buyer agrees to the General Terms & Conditions listed below.
2. Prices
2.1. All prices on the Luigi Bollini website are in euro inclusive of VAT , costs for shipping within Italy and for shipping to locations outside Italy, Luigi Bollini will add the required sales tax charged and shipping costs to the invoice.
2.2. The buyer is responsible for the shipping cost associated with the delivery of products purchased on the website as specified under the order confirmation.
2.3. The amount of sales tax charged on the order will depend upon various factors, including type of item purchased, sales price and destination of the shipment. Sales tax regulations may change between the time buyer place an order and the time of credit card charge authorization, this may affect the calculation of sales taxes. The amount appearing on buyer payment page of the cart may differ from the sales taxes ultimately charged as indicated in the invoice buyer will receive with the shipping confirmation e-mail.
3. Orders and Payments
3.1 Directly after an order is placed by email from the buyer, he will receive an email confirmation including order detail and the total cost.
3.2 The buyer can make payment to Luigi Bollini by Credit Card or Paypal in the ‘Payment’ section of the website or by Bank Transfer to Luigi Bollini, Che Banca! Gruppo Mediobanca, IBAN IT28M0305801604100571689315, BIC – SWIFT code MICSITM1XXX
3.3. Order delivery takes place once payment is received.
3.4. Luigi Bollini sends a confirmation email when the payment is received.
3.5. The products displayed on the website may be out-of-stock or discontinued and availability is not guaranteed. Please note that Luigi Bollini tried to accurately display the colours of products. The actual colours buyer see will depend on your mirror monitor and may not be accurate.
4. Delivery
4.1 The order will be made available for delivery by the carrier within 1 working week after payment is received.
4.2. A delivery confirmation email will be sent to the buyer.
4.3. Luigi Bollini is not responsible for carrier’s delayed delivery times or for all risks of loss and damage to the products from the time the same cleared Luigi Bollini business. Delivery is deemed complete and title to the products passes to buyer upon acceptance of shipment by a common carrier.
4.4. Domestic orders (Italy)
Luigi Bollini deliver by courier directly to buyer home. The fixed fee for handling, packaging and domestic delivery (Italy) is EUR 12,00. Incoming orders are usually processed and shipped by Luigi Bollini within 48 hours. Luigi Bollini shipping partner generally delivers the ordered goods in the national territory in 48 hours. Experience shows that deliveries to remote areas or islands take 1-2 days longer. To provide buyer with its order as quickly as possible and without incident, Luigi Bollini shipping partner requires a telephone number where buyer can be reached during the day (see required field in the shopping basket). Furthermore, it is helpful if buyer provide a shipping address where buyer or a trusted person is generally available. Orders will only be delivered if previous orders have been paid. The product(s) remain(s) the property of Luigi Bollini until full payment has been made.
4.5. Orders from EU Member States, Switzerland and Norway
Luigi Bollini currently deliver to the EU Member Countries. The fixed fee for handling, packaging and delivery is EUR 24,00. The fixed fee for handling, packaging and delivery to Switzerland and Norway is EUR 35,00.
Note: Any applicable buyer fees or other fees for deliveries to non-EU countries are specifically at the expense of the buyer. Deliveries are made to non-EU countries by prior arrangement only (except for Switzerland and Norway). Please contact Luigi Bollini in such cases at info@luigibollini.com. Note: Luigi Bollini online store is currently available in English. Luigi Bollini expressly point out that are not liable for any misunderstandings that might arise due to a lack of language skills.
Luigi Bollini deliver by express courier directly to buyer home. Deliveries to PO boxes and/or post restante deliveries are not possible.
Incoming orders are usually processed and shipped by Luigi Bollini within 48 hours. Luigi Bollini shipping partner pledges delivery within the European Union in 2 to 5 days. Experience shows that deliveries to remote areas or islands take 1-2 days longer. Delivery to Switzerland and Norway takes about 10 days.
To provide buyer with the orders as quickly as possible and without incident, Luigi Bollini shipping partner requires a telephone number where buyer can be reached during the day (see required field in the shopping basket). Furthermore, it is helpful if buyer provide a shipping address where buyer or a trusted person is generally available. Orders will only be delivered if previous orders have been paid. The product(s) remain(s) the property of Luigi Bollini until full payment has been made.
5. Returns
5.1 Buyer can return any item within 14 workdays after home delivery for any reason whatsoever.
5.2. Before sending any products back to Luigi Bollini, buyer will make sure that all of the following conditions have been correctly satisfied. The product you wish to return:
– notification of a return must be sent by email ( info@luigibollini.com) prior to returning the item;
– must be unused, unworn, unwashed and in the same condition in which it was received by buyer;
– must have all disposable seals still attached with the disposable seal that must still be intact;
– must be returned complete with all of its parts and accessories including the invoice;
– must be sent in its original packaging;
– must be shipped back to our fullfilment house within 5 days of the date of delivery;
– must be sent in one single shipment; products that belong to the same order must be returned to us at the same time; and
– must be shipped from the Country from which the order was placed.
Luigi Bollini would be grateful to receive a brief indication of the reasons for buyer withdrawal from the contract to enable Luigi Bollini to improve its service.
Please do not remove the labels from the goods until buyer are certain that he wish to keep the goods. Buyer right to receive additional promotional products shall be rendered void when buyer rescind the contract, and these goods must be returned. Luigi Bollini reserve the right to only accept buyer rescission of the contract if the goods have been returned in their original condition (including sales and shipping packaging).
5.3. If all of these conditions are satisfied, Luigi Bollini will refund the value of the returned product(s), Sales Tax included, less any original shipping costs.
If buyer send the package back individually, the package must be delivered within 5 days from the date of shipping at Luigi Bollini, Via Malvolta 2/3, 40137 Bologna Italy. Return shipping costs are charged to the buyer.
If buyer prefer, Luigi Bollini can send the return by UPS and charge the buyer a cost equal to € 12,000 for national shipping; € 24,00 for EU shipping; € 35,00 for Switzerland and Norway shipping. Shipping cost will be deducted from buyer merchandise refund. The withdrawal of merchandise will be as follows: the buyer will receive an email with a shipping label that he must print out and stick on the package. Then UPS will collect the package. The buyer must contact UPS in order to establish schedules and dates for the withdrawal of the package at its own address.
Luigi Bollini will not issue any refunds for returns that do not satisfy all of the conditions indicated above.
5.4. Refunds are processed within approximately 5 business days of Luigi Bollini receipt of buyer’s merchandise. Buyer’s refund will be credited back by bank transfer. Together with the return of goods buyer will inform Luigi Bollini about its bank details. Failing that, Luigi Bollini cannot be held responsible for refunds exceeding 5 days.
5.5. Luigi Bollini offer no refunds on any products designated on its site that are non-returnable.
5.6. Damage in transit
Buyer is requested to check the contents of the consignment immediately upon receipt in order to determine that the shipment is complete and undamaged. 6. Questions/Complaints
6.1. In the event of any questions or complaints related to a purchased item, Luigi Bollini would like to be informed by email ( info@luigibollini.com )
7. Privacy
7.1. All personal information will be used exclusively by Luigi Bollini and will not be released to third-parties unless necessary for payment transactions and order delivery.
8. Liability
8.1 All products in the website meet the strict requirements applicable to dog items. Luigi Bollini cannot be held responsible for any damage, including physical, material, or immaterial, that arises as a result of incorrect or poor use of the products sold by Luigi Bollini.
8.2 Though all information on the Luigi Bollini website (www.luigibollini.com) is carefully gathered, it is nonetheless possible that certain information is not correct, incomplete, or not up-to-date. Luigi Bollini is not liable for consequences arising from incorrect or incomplete information on its website.
8.3 Luigi Bollini is not responsible for type, set, and print errors as a result of which involuntary incorrect sales prices are communicated. If this occurs the price will be corrected by Luigi Bollini as quickly as possible.
8.4 Luigi Bollini cannot be held responsible for product deviations due to photo or monitor quality.
8.5. Luigi Bollini makes no representations or warranties of any kind, express or implied, as to the products included in the site nor to the merchandise being sold to buyer. To the fullest, express or implied, applicable law, provider disclaims all warranties, express or implied, including but not limited to implied warranties or merchantability, fitness for a particular purpose and non-infringement, and there are no warranties, express or implied, which extend beyond the description on the merchandise contained on Luigi Bollini order confirmation. Luigi Bollini will not be liable for any damages of any kind arising from the use of the site, including but not limited to direct, indirect, incidental, punitive and consequential damages.
9. Force Majeure
9.1. Without affecting any of its other rights, Luigi Bollini reserves the right to choose whether to suspend the processing of your order and withdraw from the agreement without judicial intervention in the event of a force majeure by advising the client of this in writing. In this case Luigi Bollini not be held responsible for any type of damage or loss, whilst acting in the interest of fairness and good faith.
9.2. In any case, Luigi Bollini shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.

– Legal duties and protection.

16.1. If any provision of these General Terms or Conditions of Sale is determined to be invalid, illegal or unenforceable, the remaining provision of these General Terms and Conditions of Sale remain in full force to the extent permitted by law.
17. Applicable Law and disputes
17.1. All agreements between buyer and Luigi Bollini are subject to Italian law, which by visiting and making use of website buyer agree to. These General Terms of Conditions are therefore subject to Italian law in case of any use of these conditions or possible dispute between buyer, Luigi Bollini and its partners.
17.2. Even though special attention is given to the translation, differences in interpretation may occur. No legal right may therefore be derived from the translated version.
17.3. Any dispute arising out of, or in connection with, this “GCS” and Sale Contract shall be settled by the Arbitration Court of Bologna.
